1. INTRODUCTION

Welcome to PandaCore, a company specialized in technological solutions, including software development, hosting solutions, game server configuration, consulting, and digital tools.

This document establishes the Terms and Conditions of Service (hereinafter, "Terms"), which govern the relationship between PandaCore and any person or entity that uses our services (hereinafter, the "Client"). By accessing or using our services, the Client acknowledges that they have read, understood, and accepted these Terms in their entirety. If you do not agree with any of the provisions set forth herein, you must refrain from using our services.

2. DEFINITIONS

For the purposes of this document, the following definitions are established:

  • Client: Natural or legal person who contracts PandaCore's services.
  • Services: Products and technological solutions offered by PandaCore, including software development, hosting, server configuration, consulting, and digital tools.
  • Software: Any program, application or system developed by PandaCore, whether custom-made or as a pre-existing tool.
  • Contract: Formal agreement between PandaCore and the Client that defines the specific terms of service provision.
  • Hosting: Software hosting service offered by PandaCore.
  • Technical Support: Service provided by PandaCore to resolve problems related to contracted products and services.
  • End User: Any person who uses the software or services provided by the Client through solutions developed by PandaCore.
  • Personal data: Information that allows the identification of a person, such as name, address, email or financial information.
  • PandaGo: Installment payment program offered by PandaCore for projects developed and hosted on PandaCore infrastructure.

3. SERVICES OFFERED

PandaCore offers a wide range of technological services, including but not limited to:

Custom software development

Creation of applications, web platforms, management systems and other digital products tailored to the Client's needs.

Hosting solutions

Web storage services, including shared, dedicated and cloud servers, with custom configurations according to Client requirements.

Game server configuration

Installation, configuration, optimization and maintenance of servers for online games, ensuring stability, security and high performance.

Technology consulting

Advice for companies and individuals on the implementation of efficient technological solutions, system audits and optimization of digital infrastructures.

4. USER ACCOUNT REGISTRATION

To access certain services, the Client may need to register an account with PandaCore. By registering, the Client agrees that:

  • They will provide truthful, updated and complete information.
  • They will be responsible for the security of their account and password.
  • They will immediately notify PandaCore in case of unauthorized access to their account.
  • PandaCore reserves the right to suspend or cancel accounts in case of misuse or breach of these Terms.

5. ACCEPTABLE USE

The Client agrees to use PandaCore's services ethically and in accordance with the law. The following is prohibited:

Illegal activities

Using the services for illegal activities, fraud or deception.

Malicious content

Distributing malware, viruses or any malicious content.

Third-party rights

Violating third-party rights, including intellectual property.

Service performance

Using PandaCore's resources for activities that affect service performance.

PandaCore reserves the right to suspend or cancel services if misuse is detected.

6. PRIVACY POLICY

PandaCore is committed to protecting the privacy and personal data of its Clients. This policy describes how we collect, use and protect personal information.

6.1. Data collected

  • Information provided by the Client: name, email address, phone number, address and payment details.
  • Service usage data: access logs, IP addresses, interactions with our platform.
  • Cookies and tracking technologies to improve user experience and optimize the service.

6.2. Use of information

The collected data is used for:

Service management

To process and manage contracted services.

User experience

To improve user experience and personalize services.

Legal requirements

To comply with legal and tax requirements.

Communications

For service communications, technical support and updates.

6.3. Storage and security

  • Information is stored on secure servers with protection measures against unauthorized access.
  • Encryption and security protocols are applied to protect data.
  • Only authorized personnel have access to Client information.

6.4. Data sharing

PandaCore does NOT sell or share personal data with third parties, except in the following cases:

  • To comply with legal obligations or government requirements.
  • To process payments through external platforms such as PayU and PayPal.
  • With essential service providers (e.g., hosting servers) under strict confidentiality agreements.

6.5. Client rights

The Client has the right to:

Access and modification

Access, modify or delete their personal data. However, deleting certain data may affect service continuity.

Usage suspension

Request suspension of the use of their information for commercial purposes.

To exercise these rights, the Client can contact us through our official channels.

7. PANDAGO – INSTALLMENT PAYMENT PROGRAM

PandaGo is a PandaCore solution that allows clients to pay for software development or contracted services in installments, thus avoiding large one-time disbursements.

PandaGo program conditions:

  • 1 Only applicable to projects requiring hosting on PandaCore infrastructure. Third-party infrastructure is not accepted.
  • 2 The source code and project files will only be released once the Client has completed all payments.
  • 3 The Client must pay monthly for PandaCore's hosting service while the program lasts.
  • 4 Upon completion of payment, the Client will receive the project's base code along with corresponding documentation.
  • 5 PandaGo is available in most Latin American countries and the United States, with some exceptions.
  • 6 In case of non-payment, the project will be deactivated immediately. During the following 90 days, the Client will receive notifications to regularize payment. If payment is not made within this period or if the Client expressly authorizes the transfer, the project will become the exclusive property of PandaCore. However, the Client may restore the service without additional penalty within those 90 days.
  • 7 If ownership is transferred to PandaCore, the company may resell the project to third parties, ensuring that no Client-specific elements are included, such as logos, images, names, data or other resources provided by the Client.

8. PAYMENTS AND BILLING

  • Payment methods

    Payments can be made through PayU (for Latin American countries) and PayPal (for most countries, including credit and debit cards).

  • Payment terms

    The Client must make payments within the agreed terms.

  • Payment delays

    In case of payment delay, PandaCore may suspend the service until the situation is regularized.

  • Refunds

    No refunds will be made except in exceptional circumstances previously agreed upon.

9. LIMITATIONS AND LIABILITY

  • PandaCore will not be liable for indirect losses, consequential damages or lost profits.
  • Services are provided "as is" and "as available".
  • In no event shall PandaCore's liability exceed the amount paid by the Client in the last 3 months.

10. MODIFICATIONS TO TERMS AND CONDITIONS

PandaCore reserves the right to modify these Terms at any time. Clients will be notified of substantial changes in advance. Continued use of the services implies acceptance of the new terms.

11. JURISDICTION AND DISPUTE RESOLUTION

These Terms are governed by the applicable laws in PandaCore's jurisdiction. Any dispute will be resolved first through negotiation and, if no agreement is reached, through arbitration or competent courts.
